TROJAN® SAFE SEX WIN TUITION/BOOKS MONEY CONTEST - OFFICIAL CONTEST RULES AND REGULATIONS
1. The “Safe Sex” contest (the “Contest”) commences at 12:01 a.m. (ET) Friday August 24, 2007 and concludes at 11:59 p.m. (ET) Monday December 31st, 2007 (“Contest Closing Date”) (the “Contest Period”). The Contest is brought to you by Church & Dwight Canada Corp. (“C&D” or “Contest Sponsor”), distributors of Trojan condoms.
ELIGIBILITY
2. (a) The Contest is open to all legal residents of the province of Ontario and Quebec Canada who are eighteen (18) years of age or older as of the first day of the Contest Period.
3. Notwithstanding this, the Contest is not open to the employees, agents or representatives of the Contest Sponsor (including their respective divisions, subsidiaries, affiliates and advertising or promotional agencies) and suppliers providing prizes or other materials or services in connection with this Contest (collectively, the "Excluded Individuals"). This Contest is also not open to the immediate family members of the Excluded Individuals, and all other persons with whom the Excluded Individuals reside.
PRIZES
4. There will be a one (1) grand prize of $1000.00 CDN (“Grand Prize”) available to be won in Canada.
DRAW
5 (a) Ten (10) business days after Contest Closing Date, one (1) entrant will be randomly selected from all eligible submission entries submitted by legal residents of the province of Ontario in Canada as the potential Grand Prize winner.
(b) Ten (10) business days after Contest Closing Date, one (1) entrant will be randomly selected from all eligible submission entries submitted by legal residents of the province of Quebec in Canada as the potential Grand Prize winner.
6 In order to be declared a winner by the Contest Judges who are employees of C&D (“Contest Judges”), a potential winner must be in compliance with these Official Contest Rules and Regulations and, in particular, the following:
6.1 Comply with the Contest entry procedures in either Section 9(a) or 10(a) below, as applicable.
6.2 A C&D employee must reach the potential winner by email within two (2) business days of the date on which the potential winner's entry was selected.
6.3 The potential winner must correctly answer, unaided and within a set timeframe, a mathematical skill-testing question administered by a C&D employee by telephone or email.
6.4 For the province of Ontario Grand Prize, the potential winner must also complete, sign and return a standard form declaration and release prepared by C&D within eight (8) business days from the date on which the form is sent to the potential winner (“Release Documentation”). The selected winner, by signing the Release Documentation, releases and indemnifies the Releasees (as defined in the Release Documentation), under the terms and conditions of the Release Documentation, from any liability in connection with the prize or the Contest. If the Release Documentation, which will include a consent, waiver and release, is not returned within the specified time period, the prize will be forfeited.
6.5 For the province of Quebec Grand Prize, the potential winner must also complete, sign and return the Release Documentation within eight (8) business days from the date on which the form is sent to the potential winner (“Release Documentation”). The selected winner, by signing the Release Documentation, releases and indemnifies the Releasees (as defined in the Release Documentation), under the terms and conditions of the Release Documentation, from any liability in connection with the prize or the Contest. If the Release Documentation, which will include a consent, waiver and release, is not returned within the specified time period, the prize will be forfeited.
6.6 In the event of any dispute regarding the identity of the party submitting an electronic entry, the entry will be deemed to have been submitted by the holder of the e-mail account.
7. If a potential winner is not in compliance with the Official Contest Rules and Regulations, the Contest Judges shall disqualify such entrant from the contest and randomly select further entrants from the remaining eligible entries until a winner is finally declared.
8. Entrants will not be individually contacted, except for selected entrant winners, who will be contacted by email.
HOW TO ENTER DRAW
9 (a) For residents of the province of Ontario, to enter for the drawing (“Contest Prize Draw”), visit the Trojan Safe Sex website (www.trojansafesex.ca/). Click on the Contest link from the website or from your Contest Entry email and follow the instructions to complete the online entry form. After completing the online entry form, confirming that you have read the Official Contest Rules and Regulations and confirming that you are aged eighteen (18) or over, you will be entered into the draw. You may enter only once. Entries will not be eligible if sent by any method not specified above or if received after the Contest Closing Date.
(b) No purchase is required to enter. Only one entry per person will be accepted during the Contest Period. All multiple entries of any kind by the same person will be disqualified.
10 (a) For residents of the province of Quebec only, to enter for the Contest Prize Draw, visit the Trojan Safe Sex website (www.trojansafesex.ca/fr). Click on the Contest link from the website or from your Contest Entry email and follow the instructions to complete the online entry form. GENERAL
11. The decisions of the Contest Judges are final, and entrants agree to abide by all of the instructions and decisions of the Contest Judges. In the event of any dispute regarding the interpretation of these Official Contest Rules and Regulations or any decision rendered by the Contest Judges, the decision or interpretation of the Contest Judges shall prevail.
12. All entries become the sole property of, and are subject to verification by, C&D. Any entry that is illegible, incomplete, altered, or contains false information, is invalid.
13. Any attempt to tamper with the entry process, interfere with these Official Contest Rules and Regulations, deliberately damage any website or undermine the administration, security or legitimate operation of the Contest, (collectively referred to as “Prohibited Acts”), is a violation of law, and the Contest Sponsors reserve the right to seek damages and/or other relief from all persons responsible for such acts to the fullest extent permitted by law, which may include banning or disqualifying entrants from this and future C&D contests. For further clarity, Prohibited Acts include, without limitation:
(i) Use of automated equipment - the use of any automated equipment to participate in this contest is prohibited.
(ii) Playing multiple instances of any game or interactive element – users are not permitted to play multiple instances of any game or interactive element at the same time in order to manipulate any point accumulation.
14. The Contest Sponsors assume no responsibility for: entries lost, stolen, delayed, damaged or misdirected, or for the failure, interruption, technical malfunction or delay of any email or other communication to be received, for any reason; any incorrect or inaccurate information, whether caused by contest website users or by an equipment or programming associated with or utilized in the contest by any technical or human error which may occur in the processing of entries in the contest; problems with the function of any website or website feature howsoever caused; the malfunction of, or damage caused to, any telephone network or lines, computer equipment, data or software, online systems, servers or access providers; any functionality lost due to not having cookies enabled; traffic congestion on the Internet; the security or privacy of information transmitted via computer networks; or for breaches of privacy due to interference by third party computer "hackers".
15. The Contest Sponsors reserve the right, in their sole discretion, to substitute any component of a prize for its cash value or a prize of approximately the same retail value or to cancel any portion of the prize. Prizes are non-transferable, must be accepted as awarded by C&D and cannot be exchanged by a declared winner for cash or other substitutes. The refusal by an entrant to accept any prize releases and forever discharges the Contest Sponsors and their agents of all obligations related to the prize, including delivery. The potential prize winner must sign the release documentation as specified in Section 6.4 and 6.5 as applicable.
16. C&D reserves the right, at its sole discretion and without prior notice, to amend, cancel, close, suspend or reinstate this Contest at any time and for any reason whatsoever.
17. By entering the Contest, each entrant agrees to abide by these Official Contest Rules and Regulations, which are subject to change without notice to Contest entrants individually, and each entrant releases the Contest Sponsors, their respective parents, affiliates, subsidiaries, directors, officers, employees, representatives, agents and advertising and promotional agencies, from any damage, loss or liability suffered as a result of or arising from the entrant’s participation in Contest or the use of any prize.
18. The Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations.
19. The Contest and these Official Contest Rules and Regulations shall be exclusively governed by and construed in accordance with the laws of the province of Ontario. Any dispute shall be adjudicated in the courts sitting in Toronto, Ontario.
20. For residents of the province of Quebec, any litigation respecting the conduct or organization of this contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
